HANABI APP TERMS OF USE

Terms of Use

Last updated: November 5, 2026

These Terms explain how you can use the App, purchase Pro, save your creations, and share your fireworks videos.

1. About these Terms and the App

These Terms of Use set out the conditions for using Fireworks Artist: Night Sky Atelier (Japanese name: 花火職人になろう 夜空のアトリエ; the “App”), provided by Kyoto Entertainment Works Inc. (“we” or “us”). Please read and agree to these Terms before using the App.

The App lets you launch and watch fireworks, create shells and launch sequences, edit and play fireworks shows, and record and share them. It does not provide instructions for making or handling real fireworks or explosives.

2. Devices and use by minors

No account registration is required. You need a suitable device and connection. You are responsible for any communication charges for downloads, watching ads, purchases and restoration, sharing, and other use.

If you are a minor, please obtain the consent of your parent or legal guardian before using the App, including before making a purchase.

3. Free features and the Pro unlock

Basic fireworks launching and viewing are free. Some creation features, fireworks types, music, and recording features have limits. A one-time Pro unlock opens the features described on the purchase screen. Pro is not an automatically renewing subscription.

Please check the App and the App Store or Google Play purchase screen for what is included and the price at the time of purchase. The store processes payment under its payment terms. Pro does not promise to include every separate product or additional service that may be offered in the future.

You can restore Pro through “Restore Purchases” in the App using the same account at the store where you bought it. Purchases cannot be transferred between the App Store and Google Play. Restoring a purchase does not restore your creations or rewarded-ad unlocks.

To request a cancellation or refund, use the support process of the store where you purchased Pro. You can also contact us if a purchased feature does not work, or about refunds or your statutory rights. These Terms do not limit any rights you have under applicable law concerning refunds, cancellation, termination, or remedies for defects.

4. Rewarded ads

Ads are rewarded ads shown only when you choose to watch one for an additional unlock. We do not show forced ads to either free or Pro users.

The unlock, number of uses, time limit, and other conditions are displayed before you choose to watch an ad. The unlock is granted when viewing is completed and the reward is confirmed. Unlocked capacity and features cannot be exchanged for cash or sold to others.

Ads may be unavailable because of connectivity, region, ad availability, or other conditions. An unlock may not be granted if you stop watching or completion cannot be confirmed. Please contact us if you complete an ad but do not receive the unlock.

5. Saving creations and deleting data

Shells, launch sequences, fireworks shows, settings, and unlock status are stored on your device. We do not store your creations on our servers or provide our own synchronization between devices.

If device backup or device transfer is enabled, the operating system may transfer your saved data. This depends on your device, operating system, backup settings, and whether a backup has been completed. Please check your backups before changing or resetting a device.

Using “Delete All Data” in the App, clearing app data in your operating system, uninstalling the App, or a device failure may result in loss of creations and rewarded-ad unlocks. We do not hold a copy of your device data from which we can restore it. Pro purchase entitlement can be restored separately from creations and ad unlocks as described in section 3.

Deleting all data in the App does not delete videos saved to your photo library or gallery, data sent to sharing services, or data in operating-system backups. Manage and delete those copies at their respective locations.

6. Copyright, recordings, and sharing

Rights in the App's software, images, music, sound effects, text, and other materials belong to us or their respective rights holders. Any copyright arising in your own creations belongs to you, while rights in our or third-party materials included in them remain with the respective rights holders. Creating or sharing your work does not transfer your rights to us.

You may post and share screenshots and videos of fireworks created or captured through normal use of the App on social media and video platforms, including the built-in music and sound effects. No separate permission is required to earn advertising revenue or use video-platform monetization features on those posts.

This permission does not include selling images or videos as stock assets, using them for business purposes such as corporate advertising, promotional materials, or commissioned work, or extracting and distributing or selling built-in music, sounds, images, or other materials separately. Please contact us in advance about asset sales or business use.

Please ensure that text and names you use, and any music, images, or other materials you add separately, do not infringe another person's copyright, trademarks, privacy, or other rights. Follow the terms of your sharing platform. This section does not restrict uses permitted by law or by a separate applicable license.

7. Prohibited conduct

When using the App, you must not:

For violations, we may take necessary and proportionate measures, such as requesting the removal of infringing content, taking account of the conduct and its impact.

8. Data and external services

Our Privacy Policy explains data handling for saved data, recording, sharing, purchases, advertising SDKs, and related features.

The App Store, Google Play, ad services, operating-system backups, and sharing services have their own terms and privacy policies. Agreeing to these Terms does not replace any separate consent required by law for advertising.

9. Changes, interruptions, and discontinuation

We may update the App or change or interrupt features to fix defects, improve features or security, or respond to changes in laws, operating systems, or stores. Operation and continued availability also depend on supported devices, operating systems, stores, and related conditions.

Except where urgent action is required, we will give reasonable advance notice in the App or on the official website of changes or discontinuation that materially affect purchased features, including what will change and when. Purchased features will be handled in accordance with applicable law and the conditions at the time of purchase.

10. Our responsibility and your rights

We are responsible under applicable law for defects in the App and for damage for which we are legally responsible in connection with the App.

These Terms do not exclude liability for our intentional misconduct or gross negligence, or exclude or limit rights to refunds, remedies, cancellation, termination, or compensation under Japan's Consumer Contract Act or other mandatory laws. Your consumer rights under applicable laws, including in the EEA and the UK, remain protected.

11. Changes to these Terms

We may change these Terms in accordance with Article 548-4 of Japan's Civil Code and other applicable laws where the change benefits users generally, or where it is consistent with the purpose of the agreement and reasonable in light of its necessity, content, and other circumstances.

We will announce the change, revised Terms, and effective date in advance in the App or on the official website. If applicable law requires your consent to a change, we will obtain that consent.

12. Governing law and disputes

These Terms are governed by Japanese law. This does not deprive you of rights under mandatory consumer protection laws applicable because of your residence or other circumstances. We do not restrict your right under applicable law to bring a dispute before a court in your place of residence or another competent court.

If any part of these Terms is held invalid, the remaining provisions continue to apply in accordance with applicable law. If the Japanese version and a translation differ, the Japanese version will serve as the reference to the extent permitted by applicable law.
